Service Agreement

BTNG Unlimited Design Subscription

Before We Start

You're about to hire us for design work. We're about to take on your business as a client. That's a relationship, and relationships work best when both sides know what to expect.

This contract isn't designed to trick you. There's no fine print meant to catch you off guard. We want to work with you for a long time, and that only happens if we're both happy with how things work.

What follows is simple. What we'll do. What we expect from you. What happens when things go sideways. Read it. Ask questions if something's unclear. Then let's get to work.

The Basics

This agreement is between:

And you, the client subscribing to our Unlimited Design service.

When you subscribe, you're agreeing to these terms. If something here doesn't work for you, let's talk before you sign up.

What You're Getting

Your subscription includes unlimited design and UX work. That means:

  • UI and UX design

  • Marketing design

  • Email design

  • Landing pages

  • Copywriting

  • Conversion rate optimization

  • E-commerce design work

  • Anything else we're capable of delivering

You also get one weekly call to discuss the work. Need to reschedule? No problem. You get one free reschedule per month. After that, missed calls are missed calls. We'll catch up the following week.

Everything we do together happens through the BTNG Portal. It works like Trello. You'll get access when your subscription starts.

How Requests Work

One request at a time. When we start something, we work on it until it's done. Then we move to the next one.

A "request" is one cohesive piece of work we can finish in 2-3 business days. If it's related and fits that timeframe, it counts as one request. A landing page? One request. A landing page plus a matching email header? Probably still one request. A landing page plus a full email sequence plus social ads? That's multiple requests.

If you add scope mid-request, we'll use our judgment. Small and related additions get included. Substantial additions get flagged as a separate request. We'll tell you which is which before moving forward.

If you submit something that's clearly weeks of work, we'll propose a breakdown into sequential requests. You can accept our breakdown or we discuss alternatives. Either way, we figure it out together before starting.

Turnaround

Most requests are completed within 48 hours. Some take 2-3 business days. Depends on complexity.

Business days are Monday through Friday, excluding Dutch public holidays.

Revisions

Unlimited. We revise until you're happy.

But here's the deal: once you approve something, it's done. If you come back weeks later wanting changes to that same deliverable, that's a new request. Unlimited revisions means unlimited revisions before approval, not unlimited do-overs forever.

What We Expect From You

This works both ways. Here's what we need from you:

Feedback. There's no strict deadline for responding to our work. But your subscription time keeps running whether you respond or not. If you take two weeks to give feedback, that's two weeks of your subscription spent waiting. Your call.

Assets. If you need to provide logos, images, copy, or access to something, get it to us when you can. If we're waiting on you, we'll use placeholders and deliver anyway. You can provide the real assets during revisions.

The weekly call. Show up, or reschedule in advance. One free reschedule per month. Miss a call without notice? We don't chase you. We'll reconnect next week.

Clarity. If your request is vague, we'll do our best interpretation. If you want something specific, be specific. We're good, but we're not mind readers.

What's Not Included

Calls on demand. One weekly call. Additional calls require mutual agreement.

Development or coding. We design. We don't build.

Requests that require more than 2-3 business days as a single deliverable. Large projects get broken into sequential requests.

Work that's unethical, political, or promotes harmful behaviour. We reserve the right to decline. If we do, we'll tell you directly and explain why.

Payment

The subscription costs €6,799 per month.

Billing happens at the start of each subscription period. Your subscription begins when we receive payment. Not before.

If a payment fails, your subscription pauses automatically. When payment comes through, we pick up where we left off. No penalty.

We accept payment via bank transfer or Stripe.

Pausing

You can pause your subscription whenever you like. No notice required.

When you pause, your unused days are saved. When you unpause, you get priority. We'll pick up where we left off within 2 business days.

Example: You subscribe on January 1st. You pause on January 15th with 16 days remaining. When you unpause, you have 16 days of service left before your next billing cycle.

Work in progress gets delivered as-is when you pause.

Here's the limit: if you stay paused for more than 60 consecutive days, we have the right to terminate the agreement. You'd need to resubscribe as a new client. We'll notify you before doing this. It's not a punishment. It's just practical. We can't hold a spot open indefinitely.

Cancellation

You can cancel anytime. No notice required.

When you cancel, work in progress gets delivered as-is. No refunds for unused time. Every subscription involves custom work from day one.

Ownership

Simple: you own everything we make for you. Full intellectual property rights transfer upon delivery.

The work is yours. We keep no claim to it.

Portfolio Use

We like showing off good work. By default, we may use work created for you in our portfolio, case studies, and marketing.

If you don't want that, tell us. We'll respect it.

If you want us to wait until a specific launch date before showing the work, tell us that too. We'll respect it.

Just communicate. We're flexible.

Confidentiality

We treat your business information as confidential. We won't share it or use it beyond delivering your work.

Need a formal NDA? Let us know. We'll sign one.

Transferring This Agreement

This subscription is tied to your company. You can transfer it to a sister company or entity under the same parent ownership. Just notify us in writing.

Different ownership? That requires a new agreement. We'd need to approve it first.

Liability

We do good work. We can't guarantee specific business outcomes. Design is one factor among many. Conversion rates, revenue, growth. Those depend on far more than what we deliver.

If something goes wrong, our liability is limited to the fees you've paid in the current billing period. We're not liable for indirect damages, lost profits, or consequences outside our control.

Changes to These Terms

We might update these terms. If we make significant changes, we'll email you before they take effect.

Continuing to use the service after changes means you accept the new terms.

Legal Stuff

This agreement is governed by Dutch law. Any disputes go to Dutch courts.

If any part of this agreement turns out to be unenforceable, we remove that part and the rest stays intact.

This document is the entire agreement between us. It supersedes any previous conversations, emails, or proposals. If we change something, it has to be in writing.
